Mintarsih Abdul Latief, the plaintiff suing for the "Blue Bird" trademark and "Burung Biru" logo, explained her reasons for suing Purnomo Prawiro, President Director of PT Blue Bird Tbk (BIRD), at the Commercial Court of the Central Jakarta District Court.

 

Mintarsih, who is also the President Director of PT Gamya Taksi Group, explained that the logo and trademark currently used by Blue Bird taxis are the same ones used when she, Purnomo, and Chandra Suharto founded CV Lestiani as the main shareholder of PT Blue Bird Taxi in 1971.

 

"Subsequently, in 2001, Purnomo and Chandra formed PT Blue Bird without the word Taxi in it. However, until now, all the logos and trademarks used by the company are the same as those used by PT Blue Bird Taxi. Even the employees and the building used were originally owned by PT Blue Bird Taxi. So I sued," said Mintarsih when contacted by CNN Indonesia on Friday (30/1).

 

Mintarsih believes she never relinquished her ownership in PT Blue Bird Taxi, so in her opinion, the establishment of PT Blue Bird was a company within a company founded by Purnomo without her consent as an initial shareholder.

 

"Even when they became a public company and were listed on the Indonesia Stock Exchange, I was not involved at all in the discussions for that plan. Purnomo only invited his children and the shareholders of PT Blue Bird," said Mintarsih.

 

PT Blue Bird Tbk (BIRD) itself was officially listed as the 19th issuer on the stock exchange on Wednesday, November 5, 2014. By offering 376.5 million shares to the public (initial public offering/IPO) at a price of Rp 6,500 per share, Blue Bird raised Rp 2.4 trillion, which will be used to fund the company's expansion.

 

Previously, through information disclosure to the Indonesia Stock Exchange, Purnomo reported that Mintarsih had filed a lawsuit with the Commercial Court of the Central Jakarta District Court on January 20, 2015.

 

The lawsuit was registered under number 01/Pdt.Sus-Merek/2015/PN.Niaga.Jkt.Pst, and in her lawsuit, Mintarsih requested that the defendants, including herself, cancel the "Burung Biru" logo and "Blue Bird" trademark registered with the Directorate General of Intellectual Property of the Ministry of Law and Human Rights.

 

"The plaintiff requests the Chairman of the Commercial Court to declare her as the sole owner, first user, and holder of the rights to the Blue Bird Taxi trademark with the Burung Biru logo," said Purnomo in the information disclosure quoted on Friday (30/1).

 

He continued, on that basis, the plaintiff requested the court to cancel and declare void and without legal force the Blue Bird trademark with the Burung Biru logo registered with the Ministry of Law and Human Rights.

 

"The defendants are also asked to pay compensation for material losses of Rp 5.65 trillion and immaterial losses of Rp 1 trillion," said Purnomo.
