Hak Paten Mesin Motor Bajaj Ditolak di Indonesia

Jakarta -Wus.. Motor Bajaj melintasi jalanan Jakarta. Iklannya pun wara- wiri di berbagai media. Namun siapa sangka, hak paten teknologi mesin motor kebanggaan masyarakat India ini menjadi masalah di Indonesia.
 
Seperti terungkap di pengadilan siang ini. Bajaj Auto Limited sebagai produsen motor Bajaj menggugat Ditjen Hak Kekayaan Intelektual (HAKI), Kementerian Hukum dan HAM (Kemenkum HAM). Sebab, permohonan paten untuk sistem mesin pembakaran dalam dengan prinsip empat langkah ditolak dengan alasan sudah dipatenkan terlebih dahulu oleh Honda Giken Kogyo Kabushiki Kaisha.
 
"Kami memohon penolakan ini dibatalkan oleh majelis hakim," kata kuasa hukum Bajaj, Agus Tribowo Sakti dalam berkas kesimpulan yang disampaikan kepada majelis hakim di PN Jakarta Pusat, Jalan Gajah Mada, Jakarta, Kamis, (29/9/2011).
 
Kasus tersebut bermula ketika Ditjen Haki menolak permohonan pendaftaran paten Bajaj pada 30 Desember 2009 dengan alasan ketidakbaruan dan tidak mengandung langkah inventif. Atas penolakan tersebut, Bajaj Auto mengajukan banding ke Komisi Banding Paten. Namun Komisi Banding dalam putusannya pada 27 Desember 2010 sependapat dengan Direktorat Paten sehingga kembali menolak pendaftaran paten tersebut.
 
"Ahli yang kami hadirkan, Andy Noorsaman Sommmeng menyatakan prinsip Bajaj adalah baru," bela Agus.
 
Menurut Andy yang memberikan kesaksian dalam sidang tersebut, satu silinder jelas berbeda dengan dua silinder. Untuk konfigurasi busi tidak menutup kemungkinan ada klaim yang baru terutama dalam silinder dengan karakter lain.
 
Namun, kebaruannya adalah ukuran ruang yang kecil. Dimana harus ada busi dengan jumlah yang sama. Hal di atas adalah baru, sebab penempatannya adalah satu mesin V (double silinder) dan lainnya adalah satu silinder
 
"Keunggulan bakan bakar yang hemat dan emisi yang ramah lingkungan adalah bentuk kebaruan," terang Agus.
 
Tapi jangan buru- buru percaya begitu saja. Sebab, Ditjen HAKI punya catatan tersendiri sehingga menolak permohonan paten ini. Yaitu, sistem ini telah dipatenkan di Amerika Serikat atas nama Honda Giken Kogyo Kabushiki Kaisha dengan penemu Minoru Matsuda pada 1985. Lantas oleh Honda didaftarkan di Indonesia pada 28 April 2006. Namun dalih ini dimentahkan oleh Bajaj.
 
"Bajaj telah mendapat hak paten di negara asalnya, India selaku satu anggota World Intellectual Property Organization," sangkal Agus.
 
Namun Ditjen HAKI tidak mau berkomentar panjang atas gugatan ini. "Nanti saya lapor pimpinan dulu," kata kuasa hukum Dirjen HAKI Ahmad Ikbal Taufik usai sidang.
 
Bajaj merupakan perusahaan yang berdiri sejak 1926. Perusahaan ini bergerak di berbagai sektor industri seperti kendaraan roda dua, kendaraan roda tiga dengan berbasis pada ilmu pengetahuan yang telah beroperasi dilebih dari 50 negara antara lain Amerika Latin dan Afrika.
